SF appeals court to hold hearing on enforcing homeless sweeps in city

(BCN) -- The 9th U.S. Circuit Court of Appeals will host a hearing Wednesday on whether to uphold a court order that bars the city of San Francisco from clearing tent encampments. In December, a federal magistrate judge ruled that San Francisco city officials cannot enforce or threaten laws against involuntary homeless people sleeping, sitting or lying on city streets. The federal judge issued a preliminary injunction on the basis that San Francisco did not have enough shelter beds for the city's unhoused population. Enforcing these laws when people did not have ample access to shelter would violate the Eighth Amendment's cruel and unusual punishment clause, she concluded. In response, San Francisco City Attorney David Chiu filed an appeal challenging the definition of what it means to be "involuntarily homeless." DENVER (KDVR) — Aurora Police are investigating a deadly shooting after officers fired at a man holding a firearm.Just before 4 a.m. Wednesday, the Aurora Police Department tweeted about a shooting near the intersection of Colfax and Havana in the Delmar Parkway neighborhood.According to Aurora Chief of Police Art Acevedo, officers were monitoring cameras in the area at around 2:30 a.m. The area is known for high activity of drug use and theft. Officers saw two men get into a confrontation and one pulled out a firearm. DENVER (KDVR) — After almost 800 volunteer hours of searching for a woman who disappeared around the Town of Fraser in the Arapahoe National Forest, the Grand County Sheriff's Office called off the search. Svetlana Ustimenko, from Florida, has been missing since July 30. Her rental car was found at the Deadhorse Trailhead near Fraser. Emergency crews responded to an abandoned airport following a report of a plane down in the Opa-locka area. Miami-Dade Fire Rescue (MDFR) dispatched an Air Rescue South unit to the area of Northwest 186th Street and Northwest 137th Avenue where they had a helicopter land on an old runway that was once part of Opa-locka West Airport.Live video footage showed the aircraft just feet away from a tree as it stopped on a patch of land just outside of an abandoned airport. Sources said the plane, which had a male and female passenger aboard, belonged to the Wayman Aircraft which is based out of North Perry Airport, located in Pembroke Pines.
